4. Medical Disclaimer
Please read this section carefully.
- The content on our Website and the guidance we provide are for educational and informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment from your physician or other qualified healthcare provider.
- Our services do not create a doctor-patient relationship unless we expressly agree otherwise in writing, and we do not diagnose, treat, cure, or prevent any disease.
- Always consult your physician before starting any new nutrition plan, supplement, exercise routine, peptide therapy, or lab-based protocol, especially if you are pregnant or nursing, have a medical condition, take prescription medication, or have had bariatric surgery.
- Never ignore professional medical advice or delay seeking it because of something you read on our Website or received from us.
- If you believe you have a medical emergency, call 911 or your local emergency number immediately.
- Statements about supplements and products have not been evaluated by the U.S. Food and Drug Administration (FDA). Products are not intended to diagnose, treat, cure, or prevent any disease.
5. No Guarantee of Results
Every person is different. Testimonials, reviews, ratings, success stories, and before-and-after examples reflect individual experiences and are not guarantees of similar results. Your results depend on many factors, including your health history, effort, consistency, and following the plan provided.
6. Your Responsibilities
By using our Services, you agree to:
- Provide accurate, complete, and current information, including your medical history, medications, allergies, and health conditions.
- Tell us promptly about any changes in your health.
- Follow your healthcare provider’s instructions and inform them about your participation in our programs.
- Keep your account, app, and patient portal login details confidential and notify us of any unauthorized use.
- Use the Services only for lawful purposes and in a respectful manner.
7. Appointments, Cancellations, and Rescheduling
- Consultations and sessions are scheduled by appointment through our team or online booking and patient-portal tools.
- Please give us at least 24 hours’ notice to cancel or reschedule. Late cancellations or missed appointments are charged a $25 fee.
- We may need to reschedule an appointment due to illness or unforeseen circumstances and will give as much notice as possible.
- Virtual sessions require a stable internet connection and a private setting. We are not responsible for sessions disrupted by technical issues on your side.
8. Payments, Packages, and Refunds
- Fees for consultations, programs, memberships, lab tests, and products are listed on the Website or provided to you before purchase. Prices may change at any time, but changes will not affect amounts you have already paid.
- Payment is due at the time of purchase unless we agree otherwise in writing. Payments are processed through secure third-party payment providers.
- App memberships: memberships renew automatically at the then-current rate until cancelled. To cancel, you must request cancellation at least 14 days before your renewal date. Requests received less than 14 days before the renewal date may not take effect until the following billing cycle. You remain responsible for charges incurred before cancellation takes effect.
- Programs and packages: all program fees are non-refundable. Before enrolling, every client is offered a complimentary onboarding call to ask questions and confirm the program is the right fit.
- Lab tests and products: once a lab kit has been ordered or a product has been shipped, it may not be returnable, particularly for items that are opened, used, or perishable. Orders placed with partner platforms are subject to those platforms’ own terms and return policies.
- You are responsible for any applicable taxes. Insurance reimbursement, if any, is your responsibility, and we do not guarantee coverage.
9. Third-Party Platforms and Links
Our Services may rely on or link to third-party platforms, including patient portals, supplement dispensaries (such as Fullscript and eHealthPro), laboratory providers, payment processors, social media sites, and video platforms. These are operated by independent companies. We do not control and are not responsible for their content, products, services, or policies. Your use of them is at your own risk and subject to their terms.
10. Intellectual Property
All content on the Website and in our programs and app, including text, articles, recipes, meal plans, videos, workout content, graphics, logos, and designs, is owned by or licensed to Innerhealthwellness and is protected by copyright, trademark, and other laws.
You may view and use our materials for your personal, non-commercial use only. You may not copy, reproduce, distribute, resell, record, publicly display, or create derivative works from our content without our prior written permission. Program materials and meal plans are provided only to the enrolled client and may not be shared with others.
11. User Content and Reviews
If you submit reviews, comments, photos, testimonials, or other content to us, you grant Innerhealthwellness a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our business, including on our Website and social media. We will not publish identifiable health details or photographs of you without your consent. You confirm that your content is truthful and does not infringe anyone’s rights.
12. Prohibited Conduct
You agree not to:
- Use the Website in any way that violates a law or regulation.
- Attempt to gain unauthorized access to our systems, accounts, or data.
- Upload viruses, malicious code, or anything that disrupts the Website.
- Copy or scrape the Website’s content using automated tools without permission.
- Harass, threaten, or abuse our team or other clients.
- Impersonate another person or provide false information.
We may suspend or terminate access to the Services if you violate these Terms.
13. Privacy
Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. We maintain HIPAA compliance practices for protected health information, to the extent HIPAA applies to our Services. By using the Services, you consent to the practices described in our Privacy Policy.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that information on it is always complete or current.
15. Limitation of Liability
To the fullest extent permitted by law, Innerhealthwellness, its owners, employees, practitioners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of, or inability to use, the Website or Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the specific service giving rise to the claim in the twelve (12) months before the claim arose.
Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Innerhealthwellness and its owners, employees, and practitioners from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any law or third-party right.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing any claim, you agree to first contact us and try to resolve the dispute informally in good faith. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Contra Costa County, California, and you consent to that jurisdiction.
18. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a new “Last Updated” date. Your continued use of the Website or Services after changes are posted means you accept the revised Terms.
19. Severability and Entire Agreement
If any part of these Terms is found unenforceable, the remaining parts remain in full effect. These Terms, together with our Privacy Policy and any written program agreement you sign with us, are the entire agreement between you and Innerhealthwellness regarding the Services.
